Terms and Conditions

1. Purpose and Scope

These terms and conditions apply to all orders placed on ginoftn.com, published by Gino Fontana. They govern the sale of digital products and consulting services.

Any order implies unreserved acceptance of these terms.

2. Products and Services

2.1 Digital Products

Access to code repositories and training videos (NoesisGen). Content and pricing are described on the relevant pages.

2.2 Consulting Services

Individual consulting sessions (writing, cognitive architecture, AI audit, solution implementation). Details, duration, and pricing are described on the relevant pages and on Cal.com.

3. Pricing

Prices are listed in euros (EUR) or US dollars (USD) depending on the product or service. VAT not applicable — Saint-Martin is outside the EU VAT territory.

Prices may be updated at any time. The applicable price is the one displayed at the time of order.

4. Order and Payment

4.1 Digital Products

Payment is processed via Stripe (credit card). Access to content is provided after payment confirmation.

4.2 Consulting Services

Booking is done via Cal.com. Payment is processed via Stripe, before or at the time of session as indicated.

5. Delivery and Access

5.1 Digital Products

Access is provided electronically (email or access link) immediately or within 24 hours of payment confirmation. No physical delivery.

5.2 Consulting Services

Sessions take place via video call or on-site (Saint-Martin / Saint-Barthelemy) as agreed.

6. Right of Withdrawal

6.1 Digital Products

Under French consumer law (article L. 221-28, 13°), the right of withdrawal does not apply to digital content supplied on a non-tangible medium where execution began with your express consent and express waiver of your right of withdrawal.

6.2 Consulting Services

For services not yet started, you have a 14-day withdrawal period from the date of contract conclusion. This right no longer applies once the service has been fully performed with your express agreement.

7. Cancellation and Refund Policy

7.1 Digital Products

Given the digital nature of products and the waiver of withdrawal rights at purchase, no refund is possible after content access.

7.2 Consulting Services

• Cancellation more than 48h before session: full refund
• Cancellation between 24h and 48h: reschedule possible, no refund
• Cancellation less than 24h or no-show: session is due

8. Legal Guarantee of Conformity

Digital content benefits from the legal guarantee of conformity under French law. In case of non-conformity, you may request that the digital content be brought into conformity.

9. Liability

Consulting services are an obligation of means, not results. Gino Fontana commits to best efforts in providing quality service.

10. Intellectual Property

Digital products are licensed for personal use. Resale, redistribution, or public sharing is prohibited without prior written permission.

11. Personal Data

Personal data processing is described in our privacy policy.

12. Mediation

In case of dispute, you may use the consumer mediation service free of charge. Mediator: designation in progress.

13. Governing Law

These terms are governed by French law. In case of dispute, jurisdiction belongs to the courts of the seller's domicile, unless otherwise provided by law.

14. Business-to-Business Provisions

For professional clients (businesses), consumer protection provisions regarding withdrawal rights, mediation, and conformity guarantees do not apply. Payment, cancellation, and liability terms may be subject to specific agreement.
